My coworker and his spouse got both physical card and CPO mail yesterday on the same day itself . His PD is Jan 2005, EB-2 India and Nebraska service center.

Just talked to a recruiter from a software giant.
She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.
Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.
But she said once the fourth quarter passes, EAD hiring is not a problem.
Folks, we should not remain quiet about this. The regulations make it illegal for an employer to discriminate based on immigration status. We should politely and respectfully pursue the authorities regarding this matter.
I would encourage you to point out the USDOJ guidelines (posted earlier) to the "software giant" employer and also contact the OSC worker hotline.
Also, would it be wise for people to post name of the company who are known to have such policies? We got one - CapitalOne from earlier posts.

I agree. Other non-useful threads are more active than this.
I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.

Initially I ignored this thread as some advertisement. Then I noticed that this thread was staying visible for several days. I got curious and started reading it and following the posts - Got convinced - Purchased the plan 2 days ago and I got my Vonage adapter today. I and my wife both have approved I-140. My PD is Dec 8, 2003 and my wife has Dec 24, 2003. I am applying as beneficiary through my wife's application. Is it possible to use my PD instead? Both are EB3.

I see soft LUD on my 485 today, but the status has not changed. I had an interview in Jan 2009 and at the end of interview the IO told me that he could not approve my case as it was not current. So I believe my case is pre-adjudicated?
Someone in the same boat? Hopefully the approval e-mail comes in the next few hours or next week. <<fingers crossed>>

Please keep writing. As many posters already pointed out - economy is getting worse and changing job may become a necessity to many of us. We cannot afford to jeopardize our green card process - if our old employer withdraws I140. Our only way is to raise and get enough attention to this issue so something is done quickly before it becomes a norm.
(I dont mean to start a ticker here on economy but following events in the recent past speak for themselves. Bankruptcies: Circuit City, LinenNThings, LehmanBrothers. Restructuring/Layoffs: AIG, MerrilLynch, Yahoo, Nortel, Cadence, eBay, Nokia, etc. Official Hiring freeze: Cisco, etc. Unoffical hiring freeze: Google (in many divisions) and a lot of medium sized companies) Look an active ticker at: http://news.cnet.com/tech-layoffs/

Actually I want to know how we can check that our I-485 is associated with EB2 and not EB3. Is there a code for this on I-485 application?

I agree with immi2006. We set ourselves apart by the Flower campaign indicating that we are law abiding and peaceful.
If some one can come up with a format which shows the tax dollars we have paid so far and the social security we have contributed and we can extrapolate it to encompass the total estimated number of EB immigrants. That would be a sizable number and will wake everyone up. If we distribute this to all the Senators/Congressmen and media it could have a huge impact.
Maybe all IV members can send the two figures:
Lifetime tax paid- One figure
Contribution to SS- One figure
We can put this in a presentable format with a write up and publish it. More ideas and thoughts please.

If you want to make changes in the existing law, we have to do far more than a letter campaign. In the coming months, there maybe opportunities where we can try provisions and bills as we see any progress on immigration reform initiatives. Lobbying effort for big changes will have to be huge.
The most important work we can do at this time is to increase our numbers. We must get as many high skilled immigrants on H1B, EAD, F1, J1, H4 etc visas under Immigration voice. Did he predict, EB2 with PD2006 will be processed before EB2 with PD 2003. Come on Guys, Give me a break and stop this rubbish. What did he predict and on what basis. enacting H.R. 5882, a modest, bipartisan bill that would simply �recapture� employment-based
immigrant visas numbers that Congress authorized in prior fiscal years, but that went unused due
to government processing delays. H.R. 5882 is a common sense measure that should be enacted
without delay this year.
H.R. 5882, which Representative Zoe Lofgren introduced with Representative Jim
Sensenbrenner, would help reduce visa backlogs by recapturing Congressionally authorized EB green cards from prior fiscal years that went unused due to bureaucratic delays.
What is H.R. 5882?
By recapturing unused green cards H.R. 5882 would address the issues of justice, equality, fairness and efficiency; at least temporarily.
H.R. 5882 addresses a very important issue of discrimination of high skilled immigrants in the US immigration system on the basis of their country of birth. As per the current law the quota of employment based green card is equally distributed to applicants on the basis of their country of birth. No single country can take more than 7% of the annual quota of 140,000 green cards. Thus the applicants born in two countries India and China, who contribute more than 50% of the high skilled immigrants, have to wait lot longer than applicants born in other country. Simply put an applicant born in XYZ country gets green card in six months and applicants born in India or China with exact same skill sets & exact same contribution to US economy has to wait for years and years indefinitely for his/her green card.
In addition to this, due to bureaucratic delays, a lot of green cards go unused from the annual quota of 140,000 every year resulting in processing backlog stretching up to decades.
What H.R. 5882 is not?
H.R. 5882 is not an amnesty. It does not legalize any illegal immigrant. It does not provide any waiver to any unlawful stay or unlawful activity in the US.
It does not increase congressionally authorized immigration limits. It does not authorize even one extra green card than what is authorized by congress.
It does not take jobs away from US, rather helps keep the job in US.
It is very important to note that the overflow of visa numbers in the family based immigration system is transferred to employment based system but NEVER vice versa.
All the high skilled immigrants who are in green card limbo are in this country for many years now and contributing to economy, paying taxes. They have steady jobs and during the three stages process of green card it has been established multiple times that a US citizen or permanent resident is not available for that job. Close to million applicants are limbo due to bureaucratic delays and country based quota system. If they get green cards they are in position to buy new house, car, start new business etc. there by making significant contribution to economy.
I request you to support the passage of the bill through US congress.

Any ideas where can I get the latest specs for the individual photos (I485 filing purpose). I searched the web but couldn't find a USCIS document. I heard they no longer accept the 75 degree looking face.

I had sent the four letters to different service centers. Got a reply letter back from TSC.
The letter says "Thanks you for your recent inquiry to the Texas Service Center (TSC) via letter for information regarding your case. ....." Seems like a standard letter template.
They returned my letter and even the envelope too. :)
