An RFE got generated on my wife's 485 application. Our company lawyer filed our 485 applications. Does anyone know who gets the RFE notice? Will it be the lawyers office or us?

I got a soft lud back in December on my approved 140 on a Sunday (along with several other IV members)... but nothing since then!
if your PD is not current then nothing to get excited about i guess sorry...

I am in my seventh year of h1. I applied for one year extension.Not granted yet.
So do I have to wait to get the extension approved ? Can I get my 140 approval and re-appy for 3 year extension and then make the move ?
I am really grateful for that bit of info previously.

They said that they were hoping that they would be able to introduce something this month , but the refuse to confirm anything . They said that the bill was still being amended and refused to give any time frame .:mad:

What happens when old I-140 is cancelled by prior sponsor. Should the beneficiary still be eligibile to port his/her priority date based on the old approved I-140 (which is now cancelled ) ?
Still the PD is yours to keep. The only time I-140 will get invalidated even for PD porting is when USCIS found fraud in that filing.

i have a trip scheduled via dubai to bombay and back. Intend to stay for 3-4 days on my way to bombay as well as 3-4 days returning back. How do i get transit visas for both of these short term visits.

Hello,
I would appreciate if somebody can provide information on how to transfer my present H1 from a company to H1 from an university. I know that H1 from university does not come under quota. Is is a regular H1 transfer?

Yes. The university simply has to apply H1-B for you.

thats what I did when I moved back to company A. My lawyer suggested as long as company A did not cancel your H1 approval you are good to go!!..Hope this helps. Good luck.

Hi All...
My attorney filed my EAD (mailed) on August 28 this year and last Friday I saw the approval too on USCIS site. Today I decided to help one of my friends with his EAD so I decided to pull the attorney filed copy of my I-765, I noticed that attorney had mentioned "AOS" in Q:15 instead of H1B. I am on H1B and I have never used my EAD... so I am worried now and I don't know what are my options now... Would you please take few minutes of your precious time and help me with the options I may have now to correct this issue?

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. Please advice how to proceed to get this process done properly, legally and fast, reasonably possible and how much time it would probably take. Thanks in advance!

Well, everyone should be proud of IV's great volunteers too who have always proved their consistent success from time to time - though big sucess yet to come! As these volunteers are just like one of us who are working full-time in their job and contribute to IV as and when they can - but I always felt that IV is managed by bunch of full-time professionals with so efficient and accurate manner! Their leading efforts to solve legal immigrant's problems are really commendable!! We are equally graced with great IV members who contributed $$ generously every time (and hope they will keep continue) and helped other way too (e.g. live update of senate sessions, news links, new immigration bills, etc...).

I have 2 H1B Transfer questions for clarification.
1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?
Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.
The 140 approval notice is not required unless this is a post six year transfer/extension.

The LCA process is the same for every state, under the new iCert LCA system. Approval can take 2 weeks, or longer if DOL does not recognize the EIN, which is very common.
