    American college kids spend most of their time partying and sex. They do not study. Only a very very few really study

    As usual typical stereotyping devoid of any reality and isn't even worth a reply. It is clear that knowledge of the above poster about ameriacn teenager comes from watching MTV.

    No wonder otherwise tolerant americans are saying "F*** You" to fraudulent indian companies trying to commit fraud under the guise of globalization.

    Called the DOS. Told them I need to travel to my home country and asked them if they can verify if my information is in PIMS. She asked if the H1-B is an extension case which it is. She said the extension cases are taking a bit longer than the new ones. That is quite surprising. Finally she looked in the database or whatever and said they do not have my extension information yet. All they have is the information from the expired petition. No timelines just asked me to call back in a week.:rolleyes:

    I need to know if anyone had any luck if their lawyers pursued this matter with the DOS.

    They generally request payment for cases that are within a certain interval of being current. For example, yesterday, we received a fee bill for an India EB2 case with a September, 2007 priority date that has been pending at the NVC for several years.

    Wait a minute, how was this India EB2 case even allowed to file I-485 when that PD has never been current? The lawyer alleges that it has been pending for several years.

    Does this "fee bill" have nothing to do with 485 filing? Is it just plain wrong or am I missing something obvious here?

    Perhaps he meant September 2006.

    I agree...

    No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.
    Don't come after me for saying this, its not my opinion. But general opinion that I have observed from people who are not well informed(read majority of people). Lets focus on the main stream media in US, outside coverage is not that significant anyway.

    There is nothing wrong in fighting. At least it will be used to prevent the same mistake in future. But it is not a bad idea to analyse the outcome so that everyone can prepare for that. My view is this campaign will be used for preventing future mistakes. I will be pleasantly surprised if we get more benefit than that. Even lawsuit also will serve the purpose and will give strong warning to USCIS.
    I can tell many examples. Due to one persons misjudgment so many American and Iraq people were killed. Do you think they can get relief? Whatever relief people got it cannot bring back peoples lives. But still lot of people are thinking that Iraq could have been handled differently and many people are fighting against War. Most people realize mistakes after someone is impacted.


    You seem to be pretty good at analyzing faults in others' ideas and thoughts . What are your suggestions to acheive releif from retrogression.

    Why don't you dispute the charges. Dispute the amout that they overcharged. Then Credit Card company will refund you that amount and deal with Embassy themselves. Which card did you use to pay (AMEX/V/MC). AMEX is the most consumer friendly in this regards.



    I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).

    I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).

    Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).

    It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.

    I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.

    I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

    Listing down things I did after my date was current-

    1: I opened an SR on July 5th (immediately after long weekend) as my date was current in July. Got back a response in a week that no visa numbers available. Either their system was not updated or they didnt check to see if dates were current.

    2: Had to wait a month before I could open another SR. In first week of August I contacted local congresswoman/opened another SR. Congresswoman reply was that the case is being actively worked on.

    3: Also, contacted the Ombudsman (mailed all the required docs) in 1st week of August. Got a response in early September that Ombudsman can help to improve procedural inefficiencies in USCIS or some extreme cases.

    4: Sent an email to SCOPSSCATA@dhs.gov on August 4th with pretty much the same details- case pending/PD etc. On same day they forwarded email to NCSCfollowup, TSC for resolution.

    5: On Aug 9th got reply from NCSCfollowup, TSC that file has been requested. To allow 60 days.

    6: After this I did not followup in any way. Then I got an email from NCSCfollowup, TSC on 17th September that my case review was complete, prints/security was over and my file would be forwarded to officers for completing.

    7: Got approval email today (September 21st).

    In my opinion the email to SCOPSSCATA@dhs.gov helped the most.

    If anyone needs any details on email/letter format please let me know. (Green.Tech, Saileshdude...)

    I'm also in same situation only difference is my visa stamped in PP is expired (Jan06), but has H1 till Jan 2009. I'm planning to visit India in Feb07 and return on AP. As I read in other forums that H1 will be valid and we can file for extension (even Cornin INS Memo (5-16-00)) memo says that. My attorney also confirmed that.

    I would suggest you to get h1 your visa stamped from India and enter on h1 and not on AP. Don't even show your AP to the immigration inspector at the POE.

    I found this forum after my I 485 denied as I applied for AOS under AC21 at texas center on 12/31/2008. The first thing I did after joining IV is sent the four letters.

    I know its a stressful time. Please follow this thread carefully, read it completely and contact ombudsman with correct form. It would be easier for all of us if CIS can see number of genuine cases which are denied wrongfully. This way, CIS may would act faster to again put your case on file and in future will not do this again.

    July Visa Bulletin to be revised?


    Please be advised that AILA, the American Immigration Lawyers Association, has just released the following announcement.



    "We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007. This revised Bulletin would retrogress some or all of the employment-based categories, very likely to the point of unavailable. Reports from AILA members about unusual levels and types of activities by USCIS indicate a particular push to adjudicate employment-based adjustments currently in the pipeline so as to exhaust visa numbers for fiscal year 2007.



    This follows the actions of USCIS in June, when it began rejecting EB-3 "Other Worker" adjustment applications even though the Visa Bulletin showed an October 2001 cut-off date, on the basis that the "Other Worker" numbers for the year had been exhausted.�



    If this is accurate, Adjustment of Status cases (I-485 cases) filed in July will all be rejected and returned to us and no AOS (I-485 cases) could be filed in July. It would also effectively cancel all Immigrant Visa appointments at US Consulates. We will provide further updates as they become available.

    Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
    Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??

    Please try to understand their problem.
    Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????

    My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

    Isn't it a shame on us to go for Rally to get GC?????:D

    Just think that you will get it when time comes, otherwise pack up.

    Please don't take much tension as life is very short. I am assuring you all, nothing will happen with law suit and flower campaign.Don't irritate USCIS by doing all this please.

    I would suggest getting involved with IV work more. Then you will understand how things work in this country. You have to raise your voices (not in defiance but as a way to appraise or educate someone about issues).

    When you meet legislators' and their staff, you are treated with respect, irrespective of their stand on immigration. Why fear when there is nothing to lose?

    Can someone share advice/experience on this scenario:

    Husband Files I140+485+ His EAD + His AP

    Wife Files I140+I485+ Her EAD + Her AP
    Addes Husband name, no EAD, no AP

    Also

    1) In order to add husband to wife's application, is it recommended to provide the alien number of Husband which he received through his own I485 filing.

    2) If a primary applicant has already added a beneficiary when dates were current, can the primary applicant choose to request an EAD for that beneficiary at a later date when the dates are no longer current.

    Appreciate any insight.

    what does 'add's husbands name' mean? Are you filing a dependent-I485 or just mentioning the name in your forms?

    you can request EAD even if dates are not current.

    I come from South Florida (MIAMI / FT LAUDERDALE /WEST PALM BEACH). Sun-Sentinel is a news paper major in this part of the world. We are expected to see a front page coverage about this turn-about by DOS and USCIS on july 07 bulletin.
