Its good to hear from ppl that they got an Yellow form from Infopass etc... I have been to San Jose USCIS office multiple times asking for status.... I just don't receive any concrete information from them...Infact, they are even hesitant to create an SR to request an update...
Any one else visited San Jose USCIS office? Similar experience, please share it with us...
and What do u mean by stating that 485 is at local USCIS office? All 485 applications will b at either NSC or TSC, rite?
I had an SR open for which i got the response as wait for 60-90 days and case is in the process of review.
I went to Infopass (San Jose) twice and both times they said, i need to wait as your case just needs to get picked up for processing and every thing else looks ok...
Called the NCSC and they also tell me to wait for 30-60 days....
What other things can we do to actually get our case picked up?

Hi All,
I got the CPO on Sep 7, 2010. But we did not get any email about dependent application. Yesterday, I just called the customer service and spoke with level 2 officer to confirm about our cases. According to him my application is still pending with the officer and no decision has been made. I am really concerned that still no approvals. Moreover, I can not even open a SR because my status shows CPO. Btw I had my FP done on Sep 3, 2010.

Apple approved Vonage iPhone App.
It allows to call India for 7 cents.
It would be good if they approve Google Voice app.
Chepcent approach is good if you have internet connection handy. Maybe vonage could have made the iPhone app to be one time fee and have it linked to World Calling Plan.

NKR .. you know what it is all about..
Looks like all these guys are newbies and do not know the process.
People who stayed long time or having awareness know the GC/citizenship
process.
I do not say we can not do anything. But has to be a bit practical & plausible.
Friend,
Do not under estimate others by your views. I am not a newbee to this forum. All others who are giving their valid comments are also not. If you do not like this, please stay away from this thread and concentrate on the threads which are interested to you.

Do you think the director just decided to forward the flowers? I am sure he must have called a Monday meeting to counter this. A suggestion during the meeting must have been to forward the flowers to the veterans.

Unfortunately the Timing of IV Advocacy day, and also May 2011 VB schedule at a wrong date. If the Govt Shutdown due to the budget deadlock, I'm not sure how both of these days will play out. Any Idea guys.
Politicians are politicians every where. India or USA their intensions are the same. Always cause a trouble to the ruling party, no mercy for the general public who suffer directly with their actions.
Shutdown means no work for 800k fedaral employees. Hence no wages. But bills won't stop.
Hope for the best.

hi,
My lawyer filed for my EAD in April 2005. I have been working on H1 all the time and i was not aware that he filed for my EAD.
HE filed for my AP at the same time and i got it. When i asked him about EAD , he said its not required and that he did not file it.
Yesterday he mailed me a set of copies in which i found receipt notice for EAD.I checked the status and it says that my case is pending since April 2005.
There was no request for any proof or anything. It just says we mailed you notice of action and the case is pending.
I need EAD now. What should i do?
I called the USCIS and they said that it is out of processing time and filed a service request.
All my friends who filed their I-485 recently got their Biometrics notice and i didn't get any. Whats wrong with my case?
I am confused , what am i supposed to do?
Appreciate your suggestion

I would not trust the lawyers in any of this, because their analysis will be superficial and not even close compared to what we see here. We have around 4-5 different folks here doing some really good sound analysis, so unless it's a lawyer known to historically make accurate predictions, I wouldn't care less about their say.
Lawyer is sharing info that some of their client have got fee invoice from NVC. I have done family based application through NVC for my parents and I know you get fees invoice almost 4 months prior to your GC interview date. So lawyer is thinking that NVC is thinking to go upto Nov 2007 in case if CIS fails to act on enough cases in last months.

File a 7001 form with the Ombudsman's office. If I remember right, IV had sent in a recommendation for the USCIS to send GC in secure mail.
An official complaint (instead of just email to ombudsman's office) will reassert IV's recommendation.

dude you are yet to show data to correlate students graduating correlating with H1 visa numbers. You say that Ms/Yahoo/Goog have no peers in India yet refuse to acknowledge these guys stand on visa status. You claim you have not found any indian with good maths skills but you can not explain the professors in top universities nor can you explain the number of phds there.

"The Computing Research Association's annual Taulbee Survey of 192 U.S. universities with doctoral programs found that total enrollment by majors and pre-majors in computer science increased 6.2% last year. If only declared majors are considered, the figure jumps to an 8.1% increase, the first boost in computer science majors in six years. "
Are you happy now? Since H1-B quota is reduced, more students are considering computer science as a viable option. If H1-B is limited only for genuine requirements by american companies for the best and brightest and not used as displacing american companies by indian crooks from TCS/INFY etc., even more americans will go for those degrees.
Are you satisfied? Now get lost!!
No I would not attribute you as representative of us culture as i meet much better people in life everyday. you obviously think that your three trips to india gave you deep understanding of indian culture which is like saying you understood quantum theory in 1 min. you obviously are talking out of your ass. and if u think "arsha-bharata" makes any sense to vast majority here you are talking out of your ass.
Go f*** urself. It was your fellow country-men (a jerk desparately trying to immigrate to US) who was making nonsense incest allegations first in this forum about americans. Do you get it,IDIOT, before lecturing me?
I don't give a damn what your epics say or what you practice in India. All I pointed out was teh corruption in India pointed out by international agencies compared to western democracies.

Great idea on focusing on the longer term and going for citizenship. Starting the 5-year clock at the time of 485 filing sounds like the practical way to do this.

For more information, we went to visit our home country and re-entered from JFK with no issue twice after 2004. We got H4 tranfered, EAD advanced Payrole too with no issue al all. Looks like "nunc pro tunc" is the solution according to Murthy. Anybody has experience with "nunc pro tunc" please post your experience. http://www.murthy.com/news/n_nunpro.html
gc4me - I have experience using "nunc pro tunc" - and it saved my I-485 (AC21).
I had just come back from vacation (09/01) and the Officer at the POE stamped my I-94 with the date on my visa (11/01), instead of the date of my then H1-B extension I-797 approval notice (03/03) which I had with me.
I explained to her she had stamped the wrong date, she said that was all I was allowed. I tought this wrong so mentioned it my attorney when I got home. My attorney confirmed that the POE Officer was wrong - so drafted a letter for me to take to my local INS Office to get the card corrected - along with one of her paralegal assistants. The Officer at the INS office took one look at the letter and supporting documents and told me I was ok as the I-797 had me covered to 2003. The paralegal then typed up a eport of the meeting with the INS, saying everything was ok, and we thought that was the end of the matter.
How wrong we were.
I next left the US to go on vacation in November 2002. By this time I had renewed my visa through the now non-existant Department of State mail in program, got my Labour Certificate, my I-140 and had filed my I-485. The issue of my erroneously stamped I-94 was a distant memory and I had no trouble getting back into the US with the new Visa, and my I-797.
The following Februaury my company ran into some problems and I was let go. Luckily I had passed the magic 180 days so was able to invoke AC21 and went to find a new job, which I did. My new employers were quite happy to take over the GC sponsorship as all they had to do was send a letter to the now USCIS and work with their lawyers.
That's where the trouble started. USCIS got the letter, put it on my file and started their review of my I-485.
They then sent me an RFE asking me to prove I had been here legally between the expiration of my old I-94 in 11/01 and when I submitted the I-485 in July 2002. (I-485 for AOS can only be submitted if you are legally in the US at time of submittal). I was devastated as it looked as though they were going to deny my I-485 due to an INS mistake.
As it was more than 365 days from when my I-94 "Expired" till I left on my next trip, I was looking at deportation and a 10 year ban from the United States.
Luckily it is a good thing I am a pack rat and keep every bit of correspondance between me and my lawyers. I was able to go to my new lawyers with the info and statements from my old lawyers about what had happened back in 2001 with the INS and my I-94 and after getting Sworn Affadavits (on pain of Perjury) from my old lawyer, paralegal and myself, we went to the local USCIS office and made an appointment with the Director and asked for a "Nunc pro Tunc" decision on the I-94 as it was clearly an INS mistake and that we had acted in Good Faith throughout in trusting the INS official.
We got the "Nunc pro Tunc" and responded to the RFE. Six weeks after that - I got the I-485 Approval notice and my passport stamped the week after.
The things for anyone to take away from my experience are.
1. When you realize a mistake has been made - act on it immediately - like I did as soon as I left the airport on September 2001
2. Document everything - to prove that you acted in Good Faith throughout the process.
Every conversation you have with someone relating to your case - your employer, your lawyer, the USCIS - get the main points in writing - email is graet for this - fire off an email - get confirmation (ok - not so helpful when talking to USCIS)
3. Keep EVERYTHING. take photocopies of I-94's, I-797's - everything. Every letter, every email. You never know when you'll need them.
4. Yes, the Government really does know where everything is in your file and they will catch even the smallest mistake.
Hope that helps you gc4me. If you can prove you acted in Good Faith throughout the whole process from finding the mistake and trying to correct it - your chances of getting the "nunc pro tunc" go up.
GOOD LUCK

This disclaimer in VB, does not say "mid-month". It takes about cut off dates via bulletin only. Also, this means USCIS put some thought behind the time they will have to announce cut-off dates. They new the demand will ber "very heavy".
**
All Employment Preference categories except for Third Other Workers have been made Current for July. This has been done in an effort to generate increased demand by Citizenship and Immigration Services (CIS) for adjustment of status cases, and to maximize number use under the annual numerical limit. However, all readers should be alert to the possibility that not all Employment preferences will remain Current for the remainder of the fiscal year. Should the rate of demand for numbers be very heavy in the coming months, it could become necessary to retrogress some cut-off dates for September, most likely for China-mainland born and India, but also possibly for Mexico and Philippines. Severe cut-off date retrogressions are likely to occur early in FY-2008.
**
This was based on information obtained then. Now they can say that they do not have enough visa numbers and all numbers are exhausted

my 485 was filed during Aug 2007 , i had EAD as well that i never used.(EB3)
i joined another firm and started off fresh using old PD, and EB2, which got ported
I had 2 RFE on my prior 485 FOR medicals and EVL. that i answered ( company didnt had issues as long as i was paying for it)
now How do i get my prior 485 to be merged, since its not an easy case, my new firm isnt willing to do so, can i raise SR/IO and try it? is it worth it
Have you asked your lawyer? Check with your lawyer first as you say it is a little complicated. You don't want to mess up this late in the process.....
