I was thinking on the same line. Why to wait at the last moment and that too when today they allowed the medical examinations to be done outside the local area. I guess, time to chill out, have some beer (i'm already having) and worry on monday. We anyway can't do anything about it on sat-sun.
yeah enjoy ur weekend. if you have filed ur application then chill and if not then ....what r u doing , lazy boy...move ur ass and courier it now.....hahahhhaha.

Today is my day. After 13 years into this country, finally I am green. I tried SR, Senator help, infopass without much help. 2 days ago when called, Texas POJ, one nice IO told me case is not yet assigned to officer, will send email, looks like worked this time. BUT this could be just incidental. Thanks IV. I have updated the profile. I only received the email, no text message.

I would like this idea to materialize but I am just wondering how it is practical.
Except for waiting for a visa number to be available all other delays are due to the time that it takes to process a case (and also due to the country quota). In labor stage, DOL determines if there is any citizen who fit in the labor description and who is looking for a job. In 140 stage, USCIS determines if the company is in good standing and has the ability to pay. In final stage, the candidate’s biometrics is taken and his background checked. All these are essential process in adjudicating a GC case in the employment category. I just do not how all these can be surpassed and candidates handed over a GC, let alone citizenship.
Allocating recaptured visa numbers and following a sensible order is more practical in eliminating some of the delays…
Most of the people in this forum or most are very highly motivated and cant wait in queues for ever due to the delays that make no sense. I am not sure whats not so clear to you. Looks like you got used to these waits. Are you used to these waits, or have no motivation to do bigger things like rising in jobs, creating companies, creating jobs, but are ok to be stuck forever in these processes that make no sense... Sorry, but not many want to wait in lines beyond the limit.

Thanks,
This is funny - one red and one green, so it turned blue now.
Anyway - can we quickly compile a list of to-dos to take this idea fwd?

What are u guys trying to acheive and how will this help EB3 India?
Also, how is the spillover going to be distributed among EB3? First EB3 ROW and then EB3 C/I as in the old system?
Personally, I think the visa recapture bill would help things quite a bit.

When you buy a home you sign a contract saying you will pay the loan amount at the end of the loan term with interest. There was a commitment made. And you are saying people who walk away without fulfilling their obligation are smart? Fool!
And who do you think is footing the bill for bailing out those banks? its you and me! You are not only dishonest and unethical, you must be really dumb if you think you are not going to be paying for the mistakes of people like punjabi when they "walk away" from their homes. Idiot!
This reminds me of the following exchange from Seinfeld :
Jerry : So were going to make the Post Office pay for my new stereo ?
Kramer : It's just a write off for them .
Jerry : How is it a write off ?
Kramer : They just write it off .
Jerry : Write it off what ?
Kramer : Jerry all these big companies they write off everything
Jerry : You don't even know what a write off is .
Kramer : Do you ?
Jerry : No . I don't .
Kramer : But they do and they are the ones writing it off .
Jerry : I wish I just had the last twenty seconds of my life back . But seriously, Punjabi, screwing up your credit history for 20,000 dollars is not a very smart move, especially if you're planning on living here for the rest of your life. Not sure if it will affect your job prospects in the future but what I AM sure of is everything else will be affected, even everyday things like getting car insurance. If you want to switch to a different insurer, your premium will increase if you have bad credit history. As someone else said, you need to really think this through because it will be a life-changing decision for you. People who are telling you to go ahead and do it just because it is legal are not giving you good advice. And people who are advising you to go ahead and do it and get a couple more credit cards and a new car while you are at it, well, these people really have no business giving anyone any advice about anything.

What you guys are talking about ... Walter reed is the best place for the flowers to go, with all what is going on in there ... the media will eat this news . DO not Cancel whatever you Do do not cancel instead call the media and let them know........... This is even better.
Can we do a blood drive next as protest! seriously. Donate blood as protest and for media attention.
I totally agree with this. A blood drive is a WONDERFUL idea. If we can get enough media outlets to cover this story it will send the right message to the Federal government. I think this will be HUGE. test101 - you are a genius !!

One of my co-workers recently went for 10th year stamping to Mumbai consulate. He was asked to wait for 4 weeks. Looks like renewals and extensions beyond 6th year are taking long time for stamping. He works for fortune 500 companies and with 20,000+ empoyees worldwide.

Question is that there are so many July 2 filers (including me) who have not got any response yet. Therefore, it is not an isolated case. I don't know if emailing to the Director does any good, as long as USCIS keeps admitting that they have not yet sent all receipts (inspite of weekly bulletins). Until 90 days are over, I guess, USCIS will be unresponsive to individual inquiries.

Also me too in the list ..... Also its better to rise a serv request , specifically make it in the req ur Courier tracking details etc. Eventhough its imp now to get in touch with respective congress men its very much imp to make this so USCIS is supposed to answer that req in 30 days if not which will add to the case.

Hi,
I have an approved I-140 (EB2 PD Jun-06) for a 'software engineering' related position. I recently moved to a 'product marketing' role within my company and was told that we would need to refile my PERM since this move constitutes a material change. Is this true?
1). Will I be able to retain my original PD of Jun-06 if we were to file for a 'marketing position'? Or would this be only possible if I needed to refile for a 'software engineering' or similar role?
2). Is there any way I can benefit from EB2 becoming current in July given that I have an approved engineering I-140 despite the fact that I have moved to marketing? (By the time I refile a new marketing PERM, I suspect retrogression will be back in effect)
3). My H1B was recently extended by 3 years (I complete 6 years in a few days) based on my 'engineering' approved I-140. They also filed an adjustment of my job duties to reflect my marketing role. I will visit Calgary, Canada next week (June) to renew my H1B stamp. Any chance that I might have problems during my interview since my 'engineering' I-140 is really not any more use since I moved to marketing? I'm just concerned that there might be problems since the 3 year extension is approved based on an 'engineering' I-140 and now I am no longer in an engineering role? Am I being paranoid :)
Thanks!

Good talent is sought after. So if one is really good, multiple companies would want to get them to work for them. That would result in multiple labor petitions.
Good talent also needs to make up its mind as to which company to stick to. The "future job" labor petition is so full of holes that its misused lot more than its used.
Individuals who are scared (company not reputed; they had issues in the past; or any other reason) tend to approach multiple companies and have them file a labor for them as a "backup".
These "backups" are the ones clogging the system right now blocking genuine petitions from getting approved / denied quicker. Otherwise even at the rate at which the DOL works, I would think a decent time for petition approval/denial under PERM would be 8 weeks instead of 16+ weeks right now
Someone gets laid off from their initial sponsoring company finds another sponsor and files a subsequent labor.
This should be a pretty genuine case, which should survive any audit. No worries here.

May I ask your immigration status. I believe you already got your GC and roaming around here just beat shit out of others. Each and every of your post is convincing me in that direction only. You would be happy to see the H1 guys thrown out from here. So it will increase your demand and you can make more money. What kind of person you are. is there any difference between you and anti-immigrant. Or are you that coming with Indian name to make fool out of us.
If you dont believe me, you read all your posts again. You are always talking about banning desi consultant. You are more than welcome for that. But you did you even thought about a second for guys who are genuine and unfortunate to work for them.
People are already stressed out. If you got your GC please go-away and enjoy your freedom.
Probably a labor sub guy who got his GC by accident and now can't land a job due to a non-existent skillset. Now how do you market yourself when you are the crappiest product: get rid of the competition and be the only show in town.

I guess the genuine companies will move the H1/L1 staff abroad along with positions to meet this requirements if at all this becomes law. What that means is more job loss in US. (Whether US has 50% of total "high skilled" work force necessary to run the operations of all the companies is another important question... I do not think so, may be the senators are considering highschool dropouts to handle the "high skilled" jobs :), I read somewhere about a recent survey and only 27% of 25-45 age group of population has a college degree in all discipline. I will try to find the link)
Over all, I see this move by senators as short sited and will prove disastrus to America in long run given the fact that no other country in the world is as dependent on technology / research and development as US.
I also saw a quote from one of the Indian offshoring company CEOs that only 25% of Indian engineers are employable. May be highschool dropouts in US may not be that bad when contrasted against that statistics, after all Bill Gates was also a dropout. Also the dime-a-dozen so-called "engineering colleges" in India that feed Indian offshoring companies are known for QUANTITY and not QUALITY. Indian students go for (or their parents pay for) those courses offered in those colleges precisely because they offer a better future - i.e. they feel they get a good ROI on their investment, even if they don't have the interest or aptitude for Computer Science or engineering. These days, these facts are known to a lot of americans working in IT.
If H1/L1 visa is restricted, that will give an incentive for americans to acquire a degree in science/engineering, just like the indian students taking courses in india offering a better ROI, as they get the feeling that they won't be discriminated in a job and investing $$$ in education is not going to be wasted. This is what President Obama also emphasized today about the need for fundamental change in unemployment allowances helping to retrain the laid-off workers.
It will no doubt cut into the obscene profit margins of TCS/INFY etc., as they will be forced to play by the rules.
