I am on a h1b currently. I changed empoyers in the US but the old stamp is still valid till semptember 2008. I has taken a visa date for jan30 in mumbai consulate and was going to fly back on feb9. Now planning to cancel the visa stamping because of the PIMS delays. I hope i am still valid to fly as i have a valid visa stamp and a new petition from current employer too which i can show at port of entry. Do let me know your views on the same and if there are any probable issues....

the Oct VB was expected gaffe by USCIS/DOS...they dont know what the hell they are doing..so continue this effort andmake more VISAS available which will make them work rather than just sit on their u know what...

I had a pre-scheduled appointment to meet my congressman's rep in his office today. I mentioned to him the issues and gave him the letter. He said addressing the president won't be of much use as it these fixed need to be taken up by lawmakers in the house. He said due to election year nothing will happen until 2009 as it requires legislative fixes and he expressed about the omnibus bill getting declined !

This is what I did -

1. Had my lawyer followup with consulate -they respond quickly to that.
2. Letter from congressman - congressman called consulate and i got a written reply from congressman on status in less than a week
3. Email followup with consulate
4. Calls to DOS - have to be on hold for a bit though..

Interview - Jan 3; 221g (pink) Phd in bio; additional info submitted - Jan 7th; consulate sent info to DOS - Jan 14th; DOS clearance - Jan 31st. Visa issued - Feb 6th...

Bpositive, thanks very much for the verification. At first, I thought my friend was just scaring me by suggesting the senator/congressman route, but seeing your case now I feel foolish as I should've been doing this in early January. I will check my status tomorrow (monday) with the Delhi consulate once more, and then, if need be (fingers crossed), will talk to my boss in Houston about your suggestions regarding congressman's letter. By the way, what if I call DOS tomorrow and they say the I've been cleared, would it still make sense to have congressman approach them? Too many questions, I know, but I guess you know this feeling. Thanks again.

Wanted to update on my Infopass appointment, I have multiple 485's pending based on separate 140's(one approved and other pending) with different A#'s and at different service centers. So was bit concerned. The IO informed me that all my 485's and 140's have been consolidated and all applications are in the same file at one service center so nothing to worry about. She also told me to use the A# from the first 485 for future communications with CIS.

People who have multiple 485's pending, my word of advise is its not a problem. CIS takes care of it. And this is true even if you have different A#'s.

Knowing the fact that so many applicants have been waiting for YEARSSSS and USCIS not doing anything about makes me sick just thinking about it. How can agency be so ignorant and continue to make thousands of people live in dark black hole for years? Has anyone heard about the new plans or action taken by either agency to reduce the backlog. According to what ombudsman said on july 20 2007 teleconference USCIS will dramatically reduce the backlog for people waiting 33 months or longer in immediate future, apparently it has been 4 months and nothing seems to have been moved yet.

worst case? yes.. it's mine..

My H1 revalidation appointment was on the 12-Dec. Visa was approved immediatly but haven't received the passport yet. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..

I had a H1 transfer to a new employer and 3 year extension happen at the same time. I am not sure what the problem is and what I can do. I am totally stressed out and really depressed ..

If someone has done something thats helped their case move along.. please PM me or reply to this post.. Thanks !

can you please let everyone know when was your H1 approved? (that will help decide the pattern for passport delay due to PIMS..)

Yes, the same law can be interpreted like this:

EB1-ROW unused visa will go to EB2-ROW
EB2-ROW unused visa will go to EB3-ROW

Same for each country.
But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?

So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.

So where is the correct interpretation? Does any body know?

Don't take me wrong here. I don't favor EB3-ROW or any particular category. I am EB3-I with PD Nov 2002.

Suppose Eb1ROW--> EB2 ROW --> EB3 ROW like you say , and EB3 ROW becomes current. Now what?

Wouldn't the unused EB3 ROW go to EB1 -C/I --> EB2 -C/I--> EB3 -C/I instead of directly EB3 ROW --> EB3 -C/I?

I think EB2 C/I is the bottleneck.

No matter what you do, pushing for the recapture bill and removing country ceiling is going to help EB immigrants overall.

In filing for I-485 no one has mentioned copy of I-140 or copy of Labor cert.

My question is how does USCIS tally an AOS application to an already approved I-140 or labor certifcation and find out the PD for the application?

My point is not everyone wud then leave Vonage and move to another service , thats how Vonage wud gain, again are u sure u read the complete fine print :P

Look up Bait and Switch (http://en.wikipedia.org/wiki/Bait_and_switch). If vonage intends to suddenly switch their offerings after gaining customers through misleading ad - then it fits the definition of Bait and Switch - which is clearly illegal in US.

So even if you leave aside the bad reputation from such a maneuver (which, in itself would be huge since their target consumer base is clearly immigrants - most of whom are savvy consumers) - Vonage may stand to lose a lot from legal fees and penalties if they try to pull such a trick. Class actions are not fun in US.
