I personally do not travel through a country that are biased and requires a transit visa for specific countries only. If you think about it, most of the international flights are full of us, Indians. If everybody (including Indians with GCs, that do not require a transit visa) start boycotting such airlines/country transits, then they will have to change this policy.

I agree we might not always have hard evidence unlike the OP here. And lot of employers might be doing this. I have never faced this, yet. However, we have to act on it. The first step is to complain to the govt. Maybe if there are lot of complaints, govt will investigate and find the dirt, and fix it.
Another idea is to bring it to the attention of the job boards that discriminatory ads should not be posted. Lets give this a try.
To those effected, write to the govt if you are in a situation where you can.

I think it would be fair to split the leftover numbers the same way they split whole year quota.
50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?
I'm wondering why you ask this question. It's not your or my perception of "fair" that will drive the DOS or USCIS but the letter of law. The law is not easy to change but the interpretation of the law which shows up in the US Code (USC) can be changed. Therefore the DOS changed their interpretation to match the INA better and my or your perception of "fair" will not change anything. On the other hand it will only lead to heartbreak and destructive discussions that lead nowhere.

This visa category is created for persons with international fame such as Nobel laureate, international fame athletes, musicians and entertainers. Today your show criticized none other than famous soccer player David Beckham. David is a highly successful international soccer player and his stature is often compared with top ten soccer player in the history of soccer. such as Pele, Maradona, Becanbaire, Platini, Ronaldo, Zidan and others. He is coming to play for LA team not to snatch your American middle class job. These fine gentlemen created and funded (still continuing) organizations that provide on going job related training to inner city kids in Chicago, New York and many large cities so that they become productive American citizens.
Come on Mr. Dobbs, show some character. Don�t just make publicity stances. Change America and provide equal opportunity for all. As a first step just become a mentor of Big Bother & Big Sister organization ( it won�t cost you a penny) and motivate a high school drop out (you may pick up a white kid because everybody knows you do not like other color) to go back to school. Present him on your show and make him as an example of how America is changing to face the challenges of globalization. The Americans are eager to see some character here. Another thought... they might have been confused with EAD through L1/B1 etc dependent and EAD through pending AOS. The first case is temporary and depends on the primary applicant status. See if thats their concern and clarify...

This needs to be advertised on the forums here or on the home page. Most people don't know what IV's expenses are.
A generic breakdown of costs, without going into specifics, would help members understand the expenses and provide some transparency.
It may even motivate new members to contribute more :)

Can you please provide me the sequence to call TSC using the POJ method? Based on what I read earlier in another thread, it was mentioned to choose option 4 which is to reports cases that were seperated. I tried that, reached an IO. IO told me that I should not be calling that number to check the status of my case. Do I need to choose another option?

POJ method can be used for all cases that are current and in the processing window...just keep on trying ur luck and I am sure you'll land a decent CSR who will be much much more useful and worth your trials and efforts.
Be persistent and you have every right to be after all you came this far.
Write to Janet Napolitano and mention that you are unfairly getting delayed and that you want to know what is holding your application and all checks and clearances done and visa number is available...

If you want to know what's really wrong with our immigration system, consider the July debacle at the Citizen and Immigration Service.
Individuals and businesses typically have to wait years to apply for "green cards" for permanent residency based on job skills. The backlogs have been so severe that an engineer from India or China has had to wait six years to apply for a green card. In other employment categories, the wait can be nine to 11 years. For people from the Philippines, the wait in some work categories is 22 years.
But then in the monthly Visa Bulletin issued June 13, the State Department said that employment-based visas would be available.
This set off a rush among sponsoring businesses and individuals who have waited in line for years to apply for green cards. Thousands prepared applications and mailed them in time for the immigration service to receive them by July 2, the first day of the application window.
Then on that very day, the State Department issued a "never mind" update, announcing that the 60,000 green cards it had expected to offer would no longer be available. The thousands who submitted applications will have their applications sent back to them.
As Los Angeles immigration attorney Carl Shusterman said last Tuesday, "We're right back to square one, with scientists, engineers, teachers and health care workers having to wait in endless lines for employment-based visas."
Rep. Zoe Lofgren, D-San Jose, chairwoman of the House Judiciary Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law sent irate letters to the Secretary of State and Secretary of Homeland Security. She said that changing course midmonth is contrary to years of practice, would result in the loss of thousands of dollars already expended by sponsoring businesses and individuals to prepare applications and, more important, would "threaten the integrity and predictability of our immigration system."
This is no way to treat people who try to play by the rules.
The Citizenship and Immigration Services Ombudsman notes in his 2007 annual report to Congress that the nation has a "perpetual backlog" of employment-based green card applications. This backlog means that even green cards that should be available aren't used. This contributes to the backlog; if green cards are not issued in the year they are authorized, they are lost.
In 2006, more than 10,000 employment-based green cards were lost, even though the immigration service had 100,000 to 150,000 applications waiting to be processed. Since 1994, nearly 219,000 employment-based green cards have been lost because the immigration service isn't processing enough applications in a timely manner.
It gets worse. The funds appropriated by Congress to jumpstart a backlog elimination project expired Sept. 30. The backlog will continue.
In the long term, this country needs to increase the number of employment-based green cards to meet demand. But if the immigration service cannot even process applications in a timely fashion for the current numbers of employment-based green cards that are supposed to be available, what's the point?
In the short term, if Congress and the president do nothing else regarding immigration reform, they should at least make sure that the immigration service processes green card applications in timely fashion. The backlog is inexcusable and contributes to the nation's illegal immigration problem. If we want people to play by the rules, we have to make it possible for them to do so.

Let us talk about the "skills" introduced by H1/L1/offshore companies
a) One guy takes the phone interview for 15 other guys with "skills" they preted to have
b) Lying on the resume with "skills" that you don't have, so that you can learn the "skill" at the expense of the client
c) "Skill" in Violating B1 visa laws and sending people on B1 to do actual work to client
d) "Skill" in violating L1 law which is used to drive down the wages by 20-30%
e) "Skill" demonstrated by indian offshorers to enter into a contract with a large corporation where they will provide warm bodies in exchange for a very low billing rate. Client wouldn't have any ability to interview the incoming cosultant, which means the offshorer employee is learning at the expense of the foolish client. Then that will be touted as "savings".
f) "Skill" of fly-by-night operators to shave off 70% of the billing rate through a 6-level pyramid of contracting companies

Yes they are very true. Except in f) Generally 6 level pyramid of contracting is financially unviable. Max I have seen is around 4. Beyond that there is nothing left.

If you want to make changes in the existing law, we have to do far more than a letter campaign. In the coming months, there maybe opportunities where we can try provisions and bills as we see any progress on immigration reform initiatives. Lobbying effort for big changes will have to be huge.
The most important work we can do at this time is to increase our numbers. We must get as many high skilled immigrants on H1B, EAD, F1, J1, H4 etc visas under Immigration voice. Once we have good support, we can try to work on various projects that helps everyone.
