Hi
I have a approved i140 with priority date of Dec 2004 EB2. My spouse has approved i140 with priority date Mar 2006 EB2.
Since it is not recomended to apply 2-1485's we decided to settle on mine. But then, since we both have our H1's for next 3 years, we don't want to use EAD and AP till the final process of GC is done.
My question is should we apply for EAD and AP or not. This question exists in the questionaire given by my employer.
Please advice.

I believe that as long as interviewing is concerned companies may have the right not to interview particular kind ("EAD holders" for an example) and interview particular kind ("GC Holder for an example..)
Not a lawyer, obviously :) , but the first line on I-9 about discrimination covers "hiring, discharging, or recruiting or referring... It is illegal to discriminate against work eligible individuals."

Everyone, Gandhigiri is a great idea. I had my skepticism initially but this is working great. Ignore cynics like Smitha. Just encourage more to send flowers.

Only thing I know is that if you come before me in the line I am affected. It is not a DMV line where every one will get their License, it is a ration line where the items are limited.
Call it selfish call it any thing else but these are the facts after being in the USA for last 12 years and two different labors.
You have every right to look after yourself. But it should not be at the expense of your comrades who are affected by this unjust system more than you are.
Solution: direct your ire against the system that is unjust to you. ( USCIS, DOL, Gov etc). That is what IV is trying to do. Let them give enough visa numbers for EB based applicants.
If many of the great leaders of the world were as selfish as we are, we would all be a herd of animals.

Nope I gave him all info with application mailed on 11 June. They shd be able to pull info with my LS, FS, DOb and center filed.. not by date filed. Lets hope for the best. Yes he could see my checks not cashed and no info about me in the system.. may be thats why he made an email inquiry to NSC.

Based on the June Bulletin, I will be filing my I485 in June.
Now, I have H1-B(with my current company till Feb'2010 that I just got approved a month back.(not stamped in passport yet)
-- Should I file EAD for myself ( I probably would want to change jobs after 180 days) ? Or is it better to be on H1-B.
-- Should I file AP for both myself and my wife(she is on H4) ?
Also, when I decide to change jobs using AC21 rule, is it better to tranfer
H1-B to a new company or if I have EAD, how does that work ?
Any inputs will be greatly appreciated..!!

Godbless, I am sure you can get your post 6 years H-1B extension based on the Cornin and new Aytes memo of 12-5-2006. Can you ask your lawyer whether it is possible to file your H-1B extension after 01/26/2007 but BEFORE June 2007 or it must be filed before the expiry of your parolee I-94? Also, you said the Immigration Officer at the POE did not let you use your H visa but the AP. Is it because you showed him both of your H-1B visa and AP? If you did not show the AP, he would probably let you enter with the H-1B visa, right?

Congrats ski_dude12. My personal opinion is that this may have delayed your greencard since July. Sometimes people get too anxious once their date is current and want to try everything that is possible to get approval. There is so much information and misinformation on forums.

First of all, they cannot ask you for you work authorization during the interview process. Second, even during hiring time, they can only ask you if you need sponsorship for H1 or not. If at this point you say no, then they have no business asking you for what kind of work authorization you have (unless the job specifically asks for US citizen or security clearence).

I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.
Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?
Response that I received for the above email:

The HR may not have a decision making power and is just following what he/she is asked to do. Just Now, I received a call from congresswomen staff. She was able to get some standard response from NSC via congrees inquiry cell at NSC[she read for me]. Still 26000 application are pending NSC prior to July 17th filer. I asked again and again same question, How they can enter data for Aug first week before July 2nd. What about FIFO? She was repeating again and again what response she got from USCIS. I was able to get I-765 # from her. I asked her how come 765 (LIN#) is possible without 485 data[she don't understand inter-dependency of application]. Stange but something is better than nothing. I will write again for FIFO. I don't want USCIS actions go unnoticed. I will do my part.
I am happy congresswomen staff did some inquiry. I will post when i received copy of USCIS official reponse to congresswomen by post/email.

Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along.
