Friends,
Finally we got our receipt numbers today from the Check Images. Our Application reached USCIS on 07/03 by USPS Mail. Don't know who signed it. Have been waiting for it patiently. All our receipt numbers start with SRC so from Texas. My I140 was approved form Texas and there was an LUD on the I140 on 07/28.
All the best for whom ever is waiting for the receipt numbers. You guys should get it pretty soon.

To set the record straight.....Mr. Hunter should first learn English Grammar. It's "I have been" not "I has been". And yeah, don't get lost in statistics, just because laws in US are designed to encourage corporate fraud in variety of forms doesn't mean corruption is any less. The only difference is low grass-roots level corruption which is direct result of differences in population density.

well, EAD is denied when MTR is denied, makes sense. But if you see the information posted by 'desi485' in this other thread (http://immigrationvoice.org/forum/showpost.php?p=302334&postcount=17), it may remain valid till validity. This is indeed confusing though. Please ask your lawyer and share with us everyone here.
There are a lot of interpretations. Popular Attorneys like Rajiv Khanna and Sheela Murthy claim it is not valid and always advise clients to have a h1b backup. Not sure why they are so keen on h1b. It could be because some adjudicators may send EAD revocations also along with 485 denials.

My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

Agreed that L1 dumping to replace a worker is violation in many cases and should be reported. If enough people complain, that might force companies to mend their illegal ways.

There are lot of things, that are/appear to be unfair, but are legal. Example - To replace 2 us workers that are earning 90k with 3 works with 60k salary. This may appear unfair (specially from workers point of view), but this is legal.
Same way, there are many legal shortcuts that allow to place a L1 worker. These companies have highly paid lawyers and their job is to find legal ways to reduce costs. For obvious reasons, I will refrain from discussing examples of such legal shortcuts. Anybody who has worked in consulting environment for enterprise level projects for 6+ years can guess them.

EB3 has a significant drop, Most of ROw applicants are filing in EB2 these days thus offsetting any significant advantage in filing EB2. EB3 will be faster comapred to EB2 some time between 2014-2015, EB3 still gets 40000 of quota.

To be specific L1B resources cannot be deployed in client premises on projects managed and controlled by client (known consulting assignments in technology world). This is just part of the violation. Second... L1B resources cannot be used for general technical skills (java/.net/oracle/production support etc) BUT can only be used for their speciality skills (while processing the L1 visa outsourcing companies shows some internal tools to prove this point). Hope this cleared your doubt, I am pretty sure that now you will be able to find a lot of violations in using L1B resources. L1B resource usage is so common that most of us who are aware of immigrations statuses even doesnt know about this .. forget others including our clients and their managers.

Tried calling USCIS they don't answer properly.
Lawyers saying can't do anything but wait and watch.
Any idea after 90 days if it's still not in their system then what to do

It really is amazing how much hot air has been generated on this thread over a well established transit visa requirement.
The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.
The list of nationals that are required to have a visa to transit the UK represents a list of countries where there has been a particular problem with over stayers. It is not race based, but merely an effort to target the problem.
It really does not matter what anyone thinks about the transit visa requirement because it is UK law. Everyone has a choice whether or not to transit the UK. Going back to the original post, to book a ticket without researching visa requirements and then trying to deflect personal responsibility by blaming the visa requirement is ridiculous.

I have posted this note on flower campaign related threads, I aplozise for polluting the threads but the point is to look forward and decide what do we want to do next.
With a successful flower campaign to USCIS, we must draw our conclusions from this success, and use the outcome to make the San Jose rally a success.
Please note that legal immigrants is a small handful set of people. Just a usual rally/demonstration will not make a dramatic impact. We have learned from the flower campaign that if we use innovative-peaceful ways of demonstrations, and manage Public Relations and Media well, we can be successful once again.
Please think and try to come up with some ideas. I have come up with these four ideas:
1. Project Martin Luther King Jr. as our hero in these rallies: Please understand that local Amrican people better understand about Martin Luther King Jr. andhis idealogy then M.K. Gandhi. My suggestion is that we should include large picture posters of Martin Luther King Jr. with a slogan "We legals too have a dream". We should also take Gandhi's posters. There is a possibility that all Black American organization may lend their support to us.
2. An act that attracts media attention: Please remember the scene from Gandhi movie when protesters led by Gandhi peacefully burned their resident permits in South Africa. To do something similar and show our symbolic protest against USCIS, we can publically burn a Photocopy of our H1B approvals (I-797). Please note that we are not asking people to burn the original I-797 approval but a photocopy of the document. This will send a message that taking the great pain in obtaining these legal documents are not helping us getting a better treatment by USCIS. This act will perfectly portrey the pain of legal immigrants and once again will attract media and newsprint to keeps us in headlines. This should be part of our demonstrations.
3. Waive American Flags: Please understand that recent media reports that only Indians are responsible for the flower campaign may hurt the campaign in the longer term. Please waive small American flags and show our solidarity with local Americans.
4. Distrubute a flower with a pamphlet to the people passing by at the demonstration site. A well worded paper will be required that can project our problems to the people.
Please share if you come up with innovative ideas to make these rallies a huge success.

Let me help you understand why I think your question reeks not only of idiocracy, but also utter disregard for even basic moral and common sense.
You wanted to buy a home, live in it for 2 years, sell it and make money. Nothing wrong with it. But, now that the market if not favorable to you, think you are not responsible for payment, and want to foreclose. All I'm saying is you are responsible for your actions; the act of buying a house, making sure you take care of it (read the contract where it says you are to take care and maintain the house to a reasonable standard), paying your monthly mortgage, insuring your home, and paying back the loan with interest by the end of the loan term. You signed the contract. You were ready to reap profits by the sale if there was equity on the home. Likewise you are to assume responsibility of payment if the home value depreciates. This is common sense. This is how the world has been. This is what they teach you as a kid. Why in the world are you complaining about depreciation when you knew this is a possibility when you bought the house?????????????????
Foreclosing is not illegal. But in your case it is unethical. I'm not even sure if your lender will let you foreclose when you don't have a real financial burden to make regular payments. You are losing 20Gs only. I assume you are capable of paying your monthly payments. You want to relocate to get a better paying job. I do not think the lender will let you of the hook so easily. And why should they? They shouldn't. They should make you pay every single penny that you owe to them!
And your questions about returning items to the store; you prove again that your a dishonest man! No, you cannot return a used item. It is wrong. Nothing legal about it. Who told you it is legal??? Congratulations to all those who are finally getting their GCs after a month long wait (a much longer wait, I know). :)
I am beginning to find out that having your priority date current does not automatically mean GC. It is just another waiting area where it is another lottery game. When you are not current, you know there are a lot of people going thru the same thing, and you hope that one day dates would be current and that things would be fine. Unfortunately I dont feel that way now. And strangely, it feels kinda lonely here in CurrentLand!

My PD is 12Jan2005, EB2-I , NSC. I have already talked to two IOs using POJ method. The first one (was very nice) told me that my case was in transit to an IO officer (she said that it was an intra-office transit) and that I should give it 4 days. I called back one week later (on 10/8/2009) and this time did not get as nice a lady - she said that may case was waiting to be assigned to an officer and that I should wait 90 days. I dont know which one to believe or if I can believe both.:confused:
A few questions:
1) Should we contact senators or congressmen, or both? What is the recommended method to contact them - through phone or through snail mail?
2) I understand that there are still many people before my PD that are waiting for their GC and I wish them the best. Should I give myself more time (say till the last week of the month for others before me to get approved) before I try the various approaches that Kewlchap and others have suggested? Or do you recommend trying all the approaches one by one right away?
3) For form 7001, do you think it should be treated as the last resort, or will I be able to save some time by starting with this? Is there any advantage if the attorney submits this for me?

Got the email about being registered as a new permanent resident on Oct 8th. Thanks to SoP, caliguy, fatjoe and all others on the forum who helped / gave me support. I essentially learned that USCIS will not move quickly on their own, they need to be pursued just like any other govt. office in India. I give my time line below for an idea of what I did. If anyone is waiting still, I sincerely think that you should do all of POJ/SR/Infopass/Senator/Ombudsman.
Timeline:
Sept 1st - became current
Sept 5th - contacted NSC several times through POJ. Finally, a very nice lady told me that my case was not even assigned to an officer. Said that she will send in a request to the contractor to pull my case out and get it assigned to an officer.
Sept 11th - Case pulled out of storage area and moved to a smaller waiting room [got this info later, but this is what had happened]
Sept 13th: Opened SR.
Sept 18th - Infopass: Told me that my case was assigned to an officer on Sept 11th (which was wrong really) and that I should wait 30 days. Also told me that my FP were renewed on March 9th and all my checks were clear.
Sept 20th: Contacted Senator's office. Said they will send in inquiry.
Sept 25: Response to SR. Case under review. Wait 30 days.
Sept 27th: Letter from Senator saying my case was under review and I need to wait 30 days.
Oct 2nd: Contacted NSC again through POJ method. A nice lady, Terry, told me that my case was assigned to officer on Sept 30th. She said, "your case was pulled out of storage and put in a rather large holding area where it was till Sept 30th." Also confirmed that my FP was renewed and other checks were clear. Said, just wait, it will happen soon.
Oct 6th: Sent 7001 form to USCIS Ombudsman.
Oct 8th: Got decision email.
Learnings: Pursue your case as much as you can. Call NSC, but be polite. They are usually in good mood on Thu/Friday evenings and if you make some small talk, they will help you. I kept records of which NSC IO is rude and if they picked up the next time, I would just keep the phone down. In fact, the lady who helped me remembered me 'coz I managed to reach her 3 times. Dont just ask for status, say that you have called in the past and so far you know xxxx about your case. Some IOs are nice, some are rude. Nice ones actually tried to explain the entire storage area, holding area, supervisor supply chain to me. I think I kind of understand the process that happens at NSC just through these conversations now. Approach Ombudsman asap with form 7001. Call your Senator office and ask to speak to the immigration person. They are very understanding and will help you.

I am beginning to find out that having your priority date current does not automatically mean GC. It is just another waiting area where it is another lottery game. When you are not current, you know there are a lot of people going thru the same thing, and you hope that one day dates would be current and that things would be fine. Unfortunately I dont feel that way now. And strangely, it feels kinda lonely here in CurrentLand!

My PD is 12Jan2005, EB2-I , NSC. I have already talked to two IOs using POJ method. The first one (was very nice) told me that my case was in transit to an IO officer (she said that it was an intra-office transit) and that I should give it 4 days. I called back one week later (on 10/8/2009) and this time did not get as nice a lady - she said that may case was waiting to be assigned to an officer and that I should wait 90 days. I dont know which one to believe or if I can believe both.:confused:
A few questions:
1) Should we contact senators or congressmen, or both? What is the recommended method to contact them - through phone or through snail mail?
2) I understand that there are still many people before my PD that are waiting for their GC and I wish them the best. Should I give myself more time (say till the last week of the month for others before me to get approved) before I try the various approaches that Kewlchap and others have suggested? Or do you recommend trying all the approaches one by one right away?
3) For form 7001, do you think it should be treated as the last resort, or will I be able to save some time by starting with this? Is there any advantage if the attorney submits this for me?

Got the email about being registered as a new permanent resident on Oct 8th. Thanks to SoP, caliguy, fatjoe and all others on the forum who helped / gave me support. I essentially learned that USCIS will not move quickly on their own, they need to be pursued just like any other govt. office in India. I give my time line below for an idea of what I did. Let me tell you I am as anxious and frustrated as you all "July 2 filers, no action yet" are. But I am thinking about it a bit calmly, rather than thinking of doing something so that I feel that I have done something (i.e. complain, write to congressman, etc.). Expressing my anger by saying they should have done this or that, does not change the situation. I believe USCIS is working, as expected, with the capability/attitude of a government worker, treating our filings (which are so important to us) just another government office paper work. Best is just to wait for another 10 days, and if nothing is heard by then, take action as per procedures.

Report indicates that the Republican National Committee voted on 01/20/2006 to back the Bush's call for a guest-worker program, and adopted a resolution that calls for continued "legal immigration," criticizes illegal immigration and endorses a "new work program for foreign workers," but states there should be "no amnesty for those persons presently in the United States illegally." There are several Comprehensive Immigration Reform bills pending in the Senate. The Senate is expected to return to the Hill next month and the specific agenda for the debate of these conflicting bills have yet to be announced by Sen. Bill Frist. He previously announced that these bills would be tabled for the debate in February. Please stay tuned to this website for the upcoming comprehensive immigration reform debates in the Hill. These bills are expected to bring a reform in the employment-based immigration increasing the employment-based immigrant visa numbers substantially. There are no strong opposition to this part of the comprehensive immigration reform.
