    I wish it should be current or atleast near to current.

    Teddy, any update to predictions based on the current status of availablity of EB1 ?

    Krish I believe that Feb - Apr 2007 is very realistic now although we don't have all the details of the news yet. 12K numbers if applied in May will lead to 4-5 months of movement not just a wekl. I do echo VDLRAO's wish there is a good chance that we maybe near the Jul-Aug 2007 line however we should wait for the May bulletin to assess that.

    Agreed. But EAD doesn�t apply to EB based immigrants alone. There are hundreds of thousands of family based immigrants who use EAD until their status gets adjusted and I-140/AC21/180 days etc. are not applicable to them. Same applies to the spouses of EB applicants. In such cases it�s a waste of time/money for the company to consult with the legal department.

    I believe it�s the responsibility of the EAD holder to communicate what he expects from the new employer (like AC21) after which the company could decide whether to go with the legal department or not. Just assuming that all EAD cases fall under I-140/AC21/180 days etc. is plain ignorance.

    Even if the EAD falls under I-140/AC21, you don't necessarily have to invoke portability. It is none of their business under what category the EAD is. I can have an EAD from I-140/I-485 filing, and then use it to work for five years at one employer, and then switch to a third employer to port the I-485. If the GC process is going to take 10 years, why should I want to invoke AC21 every time I switch a job? I would do this only at the last job I take, when my PD becomes current.

    I-485 inventory means number of 485 apps they have received or in their DB. ( simple )
    I don't think USCIS will( should ) worry about the PERM applications/140-approved applications.IMHO that' be fortune-telling business for USCIS, that so many PERM/140 approvals will directly result into so many 485 applications.

    I'm know USCIS trumped us before, but If I were to bet, I'd bet that these are straight-record count off their 485 applications.

    The real message in this thread is that you should check what is required by the countries you intend to transit BEFORE you buy your ticket.

    It seems to me that an individual should take responsibility for his own actions rather than trying to blame a particular country for a long established requirement for a transit visa.

    Maybe you can help the Brits to add more questions to their Transit Visa form from 111 to 1011.

    NEW YORK -- Lou Dobbs is sorry about calling Gov. Eliot Spitzer an idiot.

    Sincerely. As for ripping the New York Democrat as arrogant, spineless and "a spoiled rich kid brat," the host of CNN's "Lou Dobbs Tonight" stands by those nationally broadcast broadsides.

    Absolutely.

    Dobbs has made Spitzer an almost daily target over his recent plan to ease restrictions on illegal immigrants seeking New York state driver's licenses, mixing vitriol with sarcasm while endlessly lambasting the governor's decision.

    The lifelong Republican has taken on politicians of every stripe, as when he blasted the Bush administration over port security. But his nightly diatribe against Spitzer is notable for its intensity, and for elevating a state proposal onto the national stage.

    "What he's doing is an outrageous, arrogant abuse of power," Dobbs said in an interview before a recent show. "He's pandering to a constituency aligned directly against the interests of U.S. and New York state citizens."

    Dobbs's ire boiled over Tuesday night when he ripped Spitzer as an idiot _ and then offered an on-air mea culpa.

    "I'm the idiot," Dobbs said. "Governor, I apologize for calling you one. Your policies are idiotic. But I have to apologize for calling you an idiot."

    Dobbs shouldn't hold his breath waiting for a bouquet of roses (the state flower) and a thank-you note from Spitzer.

    "Mr. Dobbs has clearly demonstrated that he is not interested in a real debate on New York's driver's license policy change," said Jennifer Givner, a Spitzer spokeswoman. "He has repeatedly refused to offer balanced coverage of the issue."

    Dobbs has turned the first-term governor into a verbal pinata over his September announcement that illegal immigrants with valid foreign passports could obtain a driver's license.

    Spitzer has said the plan, set to go into effect this December, would make New York safer by bringing its 1 million illegal immigrants "out of the shadows."

    On Saturday, Spitzer cut a deal with the Bush administration that would still allow the state to issue licenses to illegal immigrants _ although the agreement required that their licenses would be clearly marked to indicate they are not valid federal ID.

    While advocates on either side of the flap said Spitzer had backed down, Homeland Security Secretary Michael Chertoff was still upset by the state's decision to license illegals.

    The Spitzer decision reversed a 2002 order by former Gov. George Pataki issued after the 9/11 attacks, and placed Spitzer directly in Dobbs' cable crosshairs. But Dobbs, while perhaps the highest-profile critics of the plan, is not alone: a state poll showed 72 percent of New Yorkers opposed Spitzer on this issue, and New York Mayor Michael Bloomberg has also expressed skepticism.

    Spitzer, in a speech last week, noted that "despite the hysteria this policy has created in some circles, it is simply a return to the policy we had for most of our state's history."

    Dobbs is hardly swayed by the history lesson, complaining the relaxed license requirement could produce voter fraud and raise security issues. Spitzer has ignored repeated invitations to appear on the program, Dobbs said; the show has turned down guests supporting Spitzer, including former national counterterrorism adviser Richard A. Clarke, according to Givner.

    Dobbs, who has made immigration one of his show's centerpiece issues, was criticized this week in a New York Times editorial for his Spitzer bashing.

    "Mr. Dobbs has trained his biggest guns on Mr. Spitzer, branding him with puerile epithets like `spoiled rich-kid brat' and depicting his policy as some sort of sanctuary program for the 9/11 hijackers," the Times wrote. "Someday there may be a calm debate, in Albany and nationally, about immigrant drivers.

    "With Mr. Dobbs at the megaphone, for now there is only histrionics and outrage."

    Dobbs isn't expecting any apology from the Times. And he has few kind words for the newspaper.

    "The New York Times is the house organ for Gov. Spitzer," Dobbs said. "They're wrong on this issue, as they are on many others."

    Dobbs draws a nightly audience of roughly 800,000, making him second in CNN viewers to Larry King's nightly program. He has no intention of lightening up on Spitzer.

    "Why should I?" Dobbs asked. "He's wrong. This issue is of vital importance to the state of New York and the nation. My job as an advocacy journalist is to confront directly abuses of power and wrongheaded politics."

    And sure enough, 24 hours after his "idiot" apology, Dobbs was again taking shots at Spitzer.

    "This governor is irresponsible," Dobbs told his audience. "It's clear arrogance. ... He has declared himself to be what people hoped he would not be _ and that is an arrogant tool of special interests."

    I m Aug-04, TSC, EB-2 .....still waiting!
    Opened SR 9/5/2009...got letter from CRIS...wait 6 months.
    For my wife , we got 60 days wait letter.
    I m the primary applicant!
    Has anyone ,tried to contact Congressman/Senetor's office?
    How can i do it?
    I m in Orange county, CA.
    I don't think calling Senator's office is going to be of great help. At least it didn't help in my case.
    You may google to find out the senator(s) for your state. Every senator must be having their own web-site. Get the phone # from their web site. Call them and tell them that you need help in Immigration and explaing them briefly. They will take your SRC # and contact TSC on behalf of you.

    Any ideas where can I get the latest specs for the individual photos (I485 filing purpose). I searched the web but couldn't find a USCIS document. I heard they no longer accept the 75 degree looking face.

    My priority date is current now and my company has already filed for my I-140. I have have two questions:

    1) My wife converted from H4 to H1b last year end and she has not gone out of the country to get any H1b stamp. Will this complicate things? Does she need to go out to get a valid H1b stamp? In case of any trouble, will it be easy for us it she converts back to H4 again?

    2) I saw that I485 processing times are taking about 6 months at the CA service center. Hence, under the current conditions, what is a better choice go: for Consular processing or Adjustment of Status? Thanks. :confused:

    Forget about it impacting desi companies, do you know how many companies will be impacted if the "no contracting" clause is retained in the H1B/L1 bill. It essentially means that no company can "purchase" the services of another company and use a H1B worker to work on the project at it's site. We are talking about biggies like IBM Consulting (where about 10% of it's workforce is on H1B) , Oracle consulting etc. who's clients depend on the expertise of the techies to help their teams by working with them onsite.
    Oracle and IBM are rich by software support and consulting services, not just by their product lines.
    Do business working on non-govt or non-defense apps care whether their contractor is on H1B or not? No they care about 2 things 1. Price 2. Can the contractor help get their system working?
    It's pretty obvious that neither of these senators have any business experience.

    How about we create a video. Take parts of this (http://www.comedycentral.com/motherload/?lnk=v&ml_video=89349) from the daily show. Take parts from the 60 minutes and read out from the NY Times article etc.

    Then post it as a reply to every Lou Dobbs video posted on you-tube.

    If somebody who has video editing/advertising/movie making skills is willing to take on this project I can definitely contribute with fact check and some money if needed.

    I received I-485 approval letter from USCIS today which reads as follows:

    "The above application has been approved. Prior to receiving your permanent resident card you may be required to report for biometrics processing (photo/fingerprint/signature). Please do not take any action at this time. If you are required to report for this processing, you will receive another notice advising you of the date, time and location to appear.

    If you have not received your permanent resident card or the above mentioned notice to appear for biometrics processing within 90 days, please call this office at the number listed above."

    Did anyone receive a notice like this? How many days did it take to get the biometric notice after this notice if anyone received the above?

    My wife already received her physical green card although she is beneficary of my application.

    I was planning on going to India in Nov, but can't book now as I don't know how long it will take :mad:

    I don't think InfoPass will entertain me to request for Biometrics especially since this notice tells to wait.

    Anyone with similar notice, any inputs are greatly appreciated. Thank you friends!!

    My lawyer only asked for the W2 ans tax returns for the last two years. I think the latest two to three years shall be sufficient unless USCIS asks for all specifically.

    Are there any instructions specifically asking for W2s and returns for all years of your stay ? or every one is including all they have just to be sure.


    My attorney is not including any w2s/tax returns at all. According to her, their firm never files these documents and got many approval without any issue. Did you see any instructions in 485 forms that says that they are required?

    On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...

    I felt the same too since I am also in the middle of H-1B transfer and my PD is current. But I spoke to my new employer's attorney and he mentioned that they are two seperate processes and should not delay things. In most cases they are considered seperate. There is always a chance. But that is rare. Even I felt that using EAD would have been better but my EAD expired and the new company decided to do H1. So things started moving with H1 and my PD became current.


    I saw LUD on my previous H1. So don't know what's going on.




    Its just that i think if IO see's that there is an H1 transfer application pending, he may delay the AOS with the current sponsor. I am just mentally preparing myself, havent seen any change in online status.
    Looking back, it might have been better to just go with EAD, that way USCIS wouldnt even know I am changing jobs then :D

    So Guys...

    This is something really cheap of you people to think.....

    I read a lot of posts where they mentioned that chuck should proceed with the bill.... so that small desi companies dont perish and that will stop abusing the H1B program...

    I really dont understand that no one condemed that remark.. Guys who work in big companies are safe by this rule... So what happens to the one sustaining the so called abuses and remaining intact to get their GC's

    No wonder we are not able to make progress as much as those illegal immi's do...

    Way to go guys... This kind of spirit will take us to great highs

    People who were skeptical before might join us next time and we might increase our numbers. This is just our first attempt. We can have a coordinated second attempt. By that I mean choosing another campaign day with IV Core. Please people don't start randomly sending things to USCIS. Let's work with IV Core and come up with a plan if we want to carry out a new campaign. If you have money to spare by sending random things to USCIS, please contribute to IV.
