I have a PD of April 2008 in the EB2-I category, but am exploring the option of switching to EB1 if possible. I am a clinical psychologist, working in a not-for-profit agency. What are my chances? Does it depend more on the case itself or a really good lawyer who can present your case in the best way it can be presented? This is a really stressful situation because my husband's H1-B runs out next summer and we cannot live here on just my income. Any feedback?
I believe the case itself is the major factor. The credentials/publications/patents + solid letters of recomendations etc is the major factor. The attorney can advice you on the types of letters or proofs that are required to substantiate your case but not more. And ofcourse once you have decided that you could potential go for the EB1, I would certainly ask others for attorneys who have had more success in EB1 cases. The "good" attorney will evaluate your total package and asks you for more documents if it is not good enough. Others will take your money and all material you send and just send it over to the CIS.

According to USCIS field manual for Adjudicators (IOs who approve 485), they should use DOL O*Net Codes, to determine same or similar, while approving. This code is mentioned in your LC.

Hi people, I am currently applying change of status from H1 to F1. Since my PERM got audit, and my h1 visa is going to expire in the end of January 2009, I need to change my status to F1 student visa in order to stay in the U.S legally. Now, I am trying to fill out the form I-539 by myself, and I got confused on:
part 4. additional information on 3g:"Have you, or any other person included in this application, been employed in the U.S. since last admitted or granted an extension or change of status?"
I don't know should I put "YES" or "NO", I have never done "i-539 for change of status" on my first F1/OPT to H1 visa....but I actually worked in the U.S...
Can anyone help me to answer that? Thanks a lot!!!

Details: Indian, in H1-B status. Current visa stamp in passport expires in mid July but employer is applying for the extension.
The situation: I want to quit my job late this summer and relocating to Asia. Before I leave this continent, I'd like to travel around South America and maybe even do some volunteer work. I'd love to travel for at least 1 and maybe even 2 months.
Ideally, I would like to re-enter the US after this trip and collect my bags before flying to India.
What are my options for re-entering?
1) Get new H1-B stamp in passport before quitting the job (though this would be kind of a pain/expense). Quit the job, ask the company not to cancel the visa and re-enter the US after the trip on the new H1 stamp. I am guessing this is a somewhat risky option as I would technically be out of status, right?
2) How hard would it be to switch to a tourist visa and get a new stamp in a country like say Argentina or Mexico?
What do you think my best option is or am I out of luck?

Does any one tried accessing USCIS case status online webpage while doing so it replied back to me saying "403 Forbidden" generally for any blocked IP's i emailed USCIS webmaster requesting why it was so as i could see my case status online a day back. Any one in same shoes? I am not worried and i feel there is no reason to get worried as most of security issues are due to false positives. IF any one in the same shoes lemme know your views.

I recently got my I140 approved and I am waiting to file my I485 as my priority date(Oct 2007) is still not current(EB2 category, India).Not sure how long it is going to take as the current backlog is July 2000 for India and China.
My brother is a citizen of the US and I need to clarify if my brother can apply for a family-based green card for me and how long does it take to get the EAD when applied through this process as compared to filing through the employer when I reach my priority date.
Also need to clarify if this process is sooner or still the same as applying through the employer.
Thanks in advance.
Current PD for sibling is 1998. I dont think there is any issues for filing thru family based GC.

First of all you are on OPT and your status has not yet changed to H1. It will change to H1 in October.
Your company can cancel H1 with or without your knowledge.
Your new employer can transfer your H1 provided you have the receipt number EAC or WAC number.
If I were you, I would first get the receipt number from your employer and then join the new company on OPT. Also if things do not work out this way, you still join the new company as you are eligible for 17 months OPT extension, you can still qualify for next years H1.
Best strategy is to use as much time on OPT as possible because in that case you dont have to pay social security and medicare taxes.

My wife is in the same boat. We filed for H1 amendment in the first week of September and online status tells it's done on 20 November. We still have not received documents in mail from USCIS. This was in Vermont. We were told initially that it might take upto 3 months.

In OHIO I have successfully renewed my DL for 4 full years solely on original I-485 receipt.
On H1 they still give 1 year extensions.
Try doing the same in your state.

As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)
Yes you can, start your company and volunteer for the company but not together :(
You can start your own company but can not work in it.
You can take a part time/ 2nd job by filing a 2nd H1 (the 2nd H1 will be in addition to your first H1), but you can't own that company!
Interestingly your wife can start a company and sponsor your 2nd H1 in her company ;)
