That's because the existing cases have not had a chance to file their I-485 and therefore are not visible in that report. Does not mean they don't exist. My case is a perfect example of that. I'm not counted in that report but I certainly exist! :-)

Yes..OCT bullettin holds the key to EB-3..if its bacck logged..then EB-3 call SOS and port to EB-2..none else will work

Also Apr'2001 was the PD given to the asylum(245i) cases by the Clinton administration. But with dates moving to Nov'2001 I believe that hump have gone past. My personal belief is EB-3 India should go around Jun-2002. But In case it remains in 2001, EB-3 Indians should take some drastic decisions. You may call me pessimist but I don't see any help coming from the congress, rather there could be some weird irrational decisions which could leave us paralysed. There are more foes than friends in the congress and lawmakers do what there pupil tells them to do. Right now the under current in US is anti immigrant..

The spillover rules that changed in 2007 will ensure that those visas will first go to E1 -> EB2 and then fall to us if there is an overflow. Unfortunately that will not happen because there are many retrogressed individuals in EB2 and they will get the visas first.

Enjoy greenhood..........no luck yet for my wife...But she got a call from USCIS office of Wash DC that it is the biometrics that is holding her approval...they are issuing a biometrics appointment....I told so far she had been issued Biometrics appointment thrice and we have not received anything.
Also if I got approved without biom availability how come she is not....she is giving crap that our job is approving the primary applicant....I told her that none of my friends have got approval just for the principal they all got approved together.
I told her Biom does not hold approval ...she was adamant we can't approve her w/o that.

I am ready for anything GC, conditional GC or Citizenship which ever comes first. If it is required funding we can start a new funding drive. But we need to start actively. Still I beleive that we should ask for conditional GC first because USCIS itself can make a rule to give a conditional GC for people who are waiting for GC more than 5 years and staying legally in this country last 10 years.
We need to collect friends who are in same situation.
We should take advise from attorney if they can give some kind of help.

Yes it is a concern that I have to address. However I see 2 ways to work around it.
1. Travel out of country get H4 stamping done based on my current H1B status
or
2. I apply for I-485 and add my wife later to the application when we have received her H4. In this case, once I have applied, I can add my wife to the application even if the dates are not current at that time.
If I were you and my priority dates were current, I would go for 1 above [get H-4 stamped ASAP and enter in US and apply for I-485].

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??

USCIS website says NSC are working with August 2007 received AOS applications. So USCIS is either not following the First in First out (FIFO) process for sure or misleading the public.

I am upto 14 letters signed, sealed and mailed to the President. I am waiting on a few more to come....It took probably an hour over the past week. Guess what...in the process I educated over 20 Americans about our issues. Guys this can have a cascading effect if we talk to people we know and get these letters. We all need to step up and actively talk to all Americans we know and get these letters. They are our support bank when its time for larger fixes and we need Americans to call their Congressman & Senators to help us.
Talk to EVERYONE you know and get a letter signed. It would be great if everyone mentioned the number of letters they have got when they put out posts on this thread. Lets not just talk the talk but WALK the TALK!!!:D
