hi all
I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

Thanks for the reply. I've also got canadian immigration as a backup and my visa is valid till April 20. I was planning to go to canada and come back to US on parole but my friends advised me to wait as from march bulletin it looks like my PD for Oct 05 will become current hopefully in the next bulletin. I was told that I might put the US case in risk as you never know what could happen when you come back.
What do you guys suggest?

RFE is requesting information about Section 212 of Immigration and Nationality Act. How big of a trouble am I in?
That depends on whether you were subject to a 2-year home residence requirement because of being in J-1 status. If you were subject to this requirement, and didn't fulfill it or get a waiver, you need to do one or the other before you get permanent residence approved.

Hi,
I'm on L1B and wife on L2B with EAD and currently working. Both are expiring on Dec 30,2010. I got my H1 with COS, which is effective from Oct 01,2010 for 1 year and my wife got H4, effective from same time. My wife's company is filing for H1 for her and has already applied for LCA. After the LCA, they are not sure whether to apply for COS from L2 to H1 before Oct 1st or if they want to wait till Oct 1st and then file for new H1 with COS from H4 to H1. In the second case, she will not be able to work till she gets her H1.
Also if they file for H1 before Oct 1st with L2 to H1 COS, and if she gets RFE, then not sure whether the whole application is invalid as my wife's status would have changed from L2 to H4 during the course.
Please advice my options. Is it OK if her company file for new H1 with COS from L2 to H1 as soon as her LCA get approved with premium processing? Is it going to be a problem if she gets RFE?
Or is it adviseable to continue to be on L1/L2 till she gets H1? If yes, how can I change my status back to L1 before Oct 1st 2010? Can my company do it me? How long the process will take? I also heard that if I go abroad and come back, I will continue to be on L1. In that case should my wife acccompany me? Do I have to go out and re enter before Oct 1st?
If I change my status back to L1, what will happen to my H1? Will it still be valid? If I'm planning to change to a different company, can it be just transferred to that company and I can work there?

If anyone knows TSC fax number, can you please share that with me. I am a July 2nd 485/ EAD/ AP filer and I didnot receive my AP yet. My H1 visa got expired and i need to goto India ASAP.

Unfortunately, we cannot search by name. You may want to provide keywords used in your question so members can find your question. I have searched for all questions related to legal immigration in all categories and weighed my opinion one way or another.
Let's hope the IV core takes up this issue and writes up a carefully crafted question so we can all benefit from the resulting voting.

Experience should be AFTER you get your degree. Also, your experience with current employer cannot be counted unless the new opening is substantially different than your current position.

Nice composition. Lighting seems a little flat/dead and it needs a little more sky detail. Did a minor bit of processing to see if I could make it better. See what you think.
