My wife will be applying for H4 visa (1 st time) some time in march. I am currently working on H1B in US.
while checking the website for documents required for H4, they ask for the Photocopy of the Principal Applicant�s valid visa.
Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
I would appreciate if you could reply me on this regard.

Yes, you can apply for H-4 despite the fact that she has an H1 petition approved. It is difficult for me to comment on her H-4 rejection chances as I am not familiar with your cases, but generally if you are on valid H-1 status then you should not have problems.

USCIS reports that 1000 H-1Bs were receipted over the past week with 34,500 now counted. 400 masters cap cases were added bringing the total to 13,000 in that category. Hi,
I need some clarification. One of my friend confued me.:confused:
My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
As per her there is no issue as she will file my EAD/AP after I come back.
Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?
Please advice.

I have taken a 2 day stop over in Dubai while coming back to USA in April 2010. I booked my flight on Emirates. Emirates will sponsor my visa. But i am not sure now they allow Advance Parole as when i apply for visa one of the requirements says "Travel documents, such as re-entry permits and refugee documents are not permitted"

Hi guys,
I got as well the unlucky audit like almost 80% of the people filing for a PERM.
My L1 visa is expiring on May 14th and the PERM audit reply was on Jan 28th and based on the current cases pending, I will hearing back from Atlanta sometimes between July-August.
I also applied for the H1-B and get approved but it is starting on Oct-1st,2008
1.- Can I stay "out-of-status" based on the INA 245 that "allow us to stay up to 180 days because change of status in process"?
2.- This changes of status process is valid only when you file the I-485 or for anyone already starting GC process like PERM in process?
3.- If I need to come back to my country and get the H1-B stamped, Do I loose the current PERM even if it get aproved or can I use the same PERM once aproved and apply for I-140/I-1485 concurrently (because EB-2 category) no matter I 'll have a different Visa H1-B instead of L1-B stated in the PERM?

I just received the I-140 Receipt Notice and noticed that the section I am filed is not correct Sec.203(b)(1)(c) i.e multi-national Executive or Manger
where as I should have been filed for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professionsal
I am going through Substitution process and the Previous I-140 was approved for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professional

My priority date will become current on June 1st 2011. I will add my wife to green card process on June 1st 2011 (she is in US in H-4 status now). My I-485 is with Texas processing Center.
If I leave my sponsoring (green card) employer after 3-4 months of getting my green card and join another employer or have my own company, does it affect my wife's green card that may be still in process

Myself and my wife got first EADs with expiration of Sept 17, 2008. We both applied for renewal on July 14th, 2008 with TSC and my wife got her EAD under a month. My wife is using it work, where as I am still on valid H1b. My application was pending still then, I have called USCIS and put an expedite request on Oct 17, 2008. On Dec 3rd, my case status online updated saying, case transfered to one of the local office. I got a paper notice after 2 days saying:
for faster processing we have transfered your case to the following location.
and nothing in the next line, blank.
Even though I assume this was to faster my process, just wanted to know whether any of you have faced this.

I know lobbying takes money, but i am not sure how much we need.
I see lots of emails about funding going around, but i am not getting any idea of how much exactly is needed.
Can the admins post a funding drive! and set some target - say, "100000$ funding drive". If we have a target, we can pitch in money and try to meet that. If we fall short, we know how much we need more, so that people can make extra contributions.
Once again, this is just my random thoughts.

IV website service provider has informed that they will be installing new hardware on the core switches that are used by IV servers. As such there is a scheduled down time of up to an hour which will occur on October 24, 2008, sometime between 12 AM CST and 6 AM CST.

My wife is planning to travel overseas for 3 months and return on AP. Her status is AoS(dependent) as she quit working on H1 a few months ago. Any experience using AP for such long stays outside the country? Please share your experiences.
