My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

Just be honest. For now you can say "No" as it is not full time. If VO asks more question on it tell them "you were not sure and ask them what it needs to be since she is doing part time. Take relavent docuemnts to show she is a part time.
All it needs to get visa is Honesty.

It's up to the employer if he wants to keep you as an employee and has the right to cancel your H1 if he likes to do so. Just because you left the country doesnt mean that your H1 becomes invalid, but again its up to the employer.
That's right. Only thing is he will be required to pay you. Make sure you get pay stubs in case you are asked to prove your status at re-entry.

Hi guys,
I know this is Off Topic (OT), but I was wondering if ALL Tax payers including immigrants on H1B will be getting the proposed tax rebates. This had happened in 2001 as well and my citizen co-workers remember getting checks.
Does anyone who was on an H1B in 2001 remember getting a similar rebate check? I definitely dont remember getting one.

You will have to open a service request (SR) with USCIS after 30 days have passed. Once you open a SR , usually service center will people will call and confirm about the current status and in about 45 days from SR open date they will try resolve the issue. If 45 days have passed, then you will have to take an infopass appointment figure out. Hope this helps!

I doubt, it has anything to do with the filing AOS before a certain date. Whatever fee is mentioned on uscis website will apply for everybody.

All this big companies as declared will reduce h1b employees in us and will do work remotely - so payroll reduction will be in us and ultimately more loss to us goverment.
if they reduce even 4 out 10 than also 6 people government will get $12k while additional 4 govt. will loose atleast tax and social security other together more than 50k and all the expenses they will do here all those money will go out of the country rather than spending done here, so many side impacts to other industries.

1. Would I be qualified to file for Writ of Mandamus (WOM)?
2. If I am qualified, would it be of any benefit for me to file WOM based on my criteria as

That actually is the right way to do it.. Once your project is done technically your H1 is expired and you need to return to your home country.
Yes, you can file for a transfer and travel anywhere you want but for reentry you will need the transfer notice or approval notice from the new company, which can be mailed to you. If you already have a visa stamp then just show the new approval (transfer) and they will let you come in.

What if, only H4 holder (AOS pending) returns to USA using valid (till Dec' 09) H4 stamping ? Do they (at POE) come to know that spouse's 485 has been approved ?
H1 holder (485 approved) will return afer couple of days.
Urgent please help by giving your suggestions/opinions/experiences.

We filed 2 - 485 applications for each of us(One is primary in one set(Husband) and the other one is primary as second application(wife)). Both of our lawyers said it is ok to file like this. Once we get the 485 approval in few years we have to withdraw the sencond application.
